The proposal to improve EU legislative and regulatory framework conditions for research and innovation should mention of legitimate interests to opt out (as closed as possible as open as necessary).

ERA action 2 states that datasets which are results of publicly funded research should be opened. In the Open data directive and also in the new Finnish legislation from last year the definition is narrower: “the data which has already been published.”

The cost for open and FAIR data provisions beyond the duration of the project has not been addressed and will result in increasing overhead costs for RPOs.

Text and data mining (TDM) should be allowed. It would promote the development of new tools for research. The current situation allows high fees for TDM, resricts the storage, handling and usage the datasets and hinders the development of the research. If the data is accessible it should be allowed to use it for several TDM purposes.

Self-archiving of the scientific publications should be more flexible. At least there should the limit for the embargo period at maximum one year. Also the format of the article should not be so restricted as it is now.
